The practical implementation of an affectively structured government, one in the hierarchical form he mentions, one where no one is reasonably held socially responsible for matters beyond personal experience, still requires a general understanding of the fundamental rights it's properly intended to protect. For instance, a well-structured social system which includes private property rights would look drastically different from one that includes none, but both could be judged as effective, from said differing philosophical perspectives. No government, however, can protect rights it doesn't even recognize, much less institutionalize, by written law, of which every single individual must be knowledgeable, to which every single individual must adhere.
